General provisions
1.1 These Terms and Conditions of Trade (hereinafter referred to as the "Terms and Conditions") set out the rights, obligations and responsibilities between the person purchasing goods from www.gautora.lt (hereinafter referred to as the "Buyer") and Gautora UAB (hereinafter referred to as the "Seller"). By purchasing goods in the online shop, the Buyer agrees to these Terms and Conditions.
1.2 The contract for the sale of goods between the Buyer and the Seller (hereinafter referred to as the "Contract") shall be deemed to have been concluded as of the moment when the Buyer, having created a shopping cart in the e-shop, indicated the delivery address, selected the method of payment and having read these Terms and Conditions, clicks on the button "Confirm order". Once the Buyer has completed the above steps, the Seller shall send a confirmation that the order has been accepted to the e-mail address provided by the Buyer, indicating the exact price of the goods.
Rights and obligations of the buyer
2.1 The Buyer shall have the right to purchase Goods in the e-shop in accordance with these Terms and Conditions and the legislation of the Republic of Lithuania.
2.2. The Buyer (consumer) shall have the right to withdraw from the contract for the purchase and sale of goods concluded in the online shop with the Seller (except in the case of a contract for the purchase and sale of audio and/or video recordings (phonograms, audiovisual recordings) in various video and audio media, the supply of computer programs if the Buyer has violated the packaging protections; the supply of newspapers, magazines or other periodicals; participation in games and lotteries; the provision of services where, with the consent of the Buyer, the Sales Contract has been entered into before the expiry of a period of seven working days; the provision of goods which have been made to the Buyer's individual order or have been obviously tailored to the Buyer's needs or which, by their nature, after their provision to the Buyer are no longer returnable due to loss of merchantable qualities, are perishable or have expired). This must be notified in writing to the Seller within 7 working days from the date of delivery. The Buyer shall have the right to withdraw from the contract of sale with the Seller only if the goods are of good quality, have not been damaged and have not been substantially altered in appearance.
2.3 Electrical goods are not covered by warranty and are not accepted for return (in accordance with the Return and Exchange Policy of the Republic of Lithuania).
2.4 The Buyer shall have other rights and obligations set out in these Terms and Conditions and in the legislation of the Republic of Lithuania.
2.5 The Buyer undertakes to pay the price of the Goods and their delivery within the time limit and to accept the Goods ordered.
Seller's rights and obligations
3.1 The Seller undertakes to provide all the conditions for the proper use of the e-shop services by the Buyer, but the Seller does not give any guarantee that the e-shop will operate uninterrupted or that data transmission will be uninterrupted and shall not be liable for any minor inaccuracies.
3.2 The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer within the specified time limit.
3.3.If for important reasons or technical problems the Seller is unable to deliver the product(s) ordered by the Buyer, the Seller undertakes to offer the Buyer an analogue product, and in the event of the Buyer's refusal to accept the analogue product, the Seller shall refund the Buyer's payment within 10 working days. In this case, the Seller shall be released from liability for non-delivery of the goods.
3.4 If the Buyer attempts to interfere with the operation of the e-shop and its proper functioning, the Seller shall have the right to restrict and/or suspend the Buyer's access to the e-shop and/or cancel the Buyer's registration in the e-shop without prior notice to the Buyer.
3.5 The Seller has the right to unilaterally change these Terms and Conditions. The amended Terms and Conditions shall enter into force from the moment of their publication in the online shop and shall apply to all purchase and sale contracts concluded after the publication of the Terms and Conditions.
3.6 The Seller shall have other rights and obligations specified in the Rules and the legislation of the Republic of Lithuania.
Price and payment of goods
4.1.The final price of the Goods is stated in the Online Shop, i.e. the price includes the applicable rate of value added tax (the price of the Goods does not include delivery charges).
4.2 The Buyer undertakes to pay for the Goods within 1 (one) working day in the form offered by the Seller. If the Buyer fails to pay the price within the specified period, the Buyer shall be deemed to have refused to perform the Contract and the Seller shall be entitled to suspend the execution of the order.
4.3 The Buyer may pay the Seller for the goods selected and ordered in the e-shop in three ways:
4.3.1. cash on delivery to the courier. If you choose this method of payment, the order will be processed immediately and you must have the exact amount of money for the order when the courier arrives.
4.3.2 Using e-banking services.
4.3.3 By bank transfer: (cash deposit or transfer from an account) to the seller's bank account (in euros). Please indicate the order number you have been given in the payment method. After the transfer has been made, please be sure to inform us by email at sales@gautora.lt. The order will not be processed until we have received information about the order, as the order status remains unchanged and is visible as "unpaid". If you have placed an order but have not yet received the goods and would like a refund, please inform us by phone or email. The manager will inform you how and where to submit the completed request (XLSX or PDF file).
4.4 The invoice will be issued by the Seller upon delivery of the Goods and will be sent to the Buyer by email.
Delivery of goods
NOTES:
- Delivery to UAB Gautora store, regardless of the amount of goods purchased, is FREE of charge.

5.1 The Goods shall be delivered by Venipak courier at the Buyer's expense.
5.2 The exact price of the Goods, the delivery price, the quantity and range of the Goods, and the delivery date shall be specified in the order for the Goods confirmed by the Seller. In very rare cases, some Goods may not be sold in lots of 1, and you may be informed of this within 4 working hours of placing your order.
5.3 At the time of delivery of the Goods, the Buyer (the Buyer's representative) undertakes to inspect the condition of the packaging of the consignment of the Goods, the quantity, quality and assortment of the Goods.
5.4.In the event that a breach of the packaging of the consignment of Goods is detected, but no discrepancy(s) in the quantity, quality or range of the Goods has been detected, the Buyer (the Buyer's representative) shall note the breach of the packaging of the consignment of Goods in a document provided by the Seller (the Seller's representative).
5.5 In the event of any discrepancy(s) in the quantity, quality and/or range of the Goods, the Buyer (the Buyer's representative) must not accept the consignment of Goods. In this case, the Seller (Seller's representative) or the courier together with the Buyer (Buyer's representative) shall execute a non-acceptance certificate, in which the irregularities and discrepancies found shall be noted in writing.
5.6.After the Buyer (Buyer's representative) has accepted the consignment of Goods, signed the relevant delivery document and noted the damage to the packaging of the consignment of Goods, it shall be deemed that the Goods have been delivered in the damaged packaging of the consignment, but that the quantity, quality and range of the Goods are in accordance with the terms and conditions of the Sales Contract, and that the additional services indicated in the delivery document have been properly performed.
5.7 Upon acceptance of the consignment of Goods by the Buyer (the Buyer's representative) and signing the relevant delivery document without comments, the Goods shall be deemed to have been delivered in the undamaged packaging of the consignment, to be of the same quantity, quality and range as the terms and conditions of the Sales Contract, and to be duly performed in accordance with the additional services set out in the relevant document.
5.8 Upon delivery of the Goods to the address specified by the Buyer, the Goods shall be deemed to have been handed over to the Buyer irrespective of whether the Goods are actually received by the Buyer or by any other person who has received the Goods at the specified address. If the goods are not delivered on the scheduled delivery date, the Buyer shall notify the Seller immediately, but not later than the day after the scheduled delivery date. Otherwise, the Buyer shall forfeit the right to claim against the Seller in respect of non-delivery or late delivery of the Goods(s).
Return of goods
NOTES:
- We will accept with a smile goods purchased in the Gautora e-shop, provided the return period does not exceed 14 calendar days.
- To ensure smooth and inexpensive returns, we encourage our customers to contact us on the general telephone number and send their parcels via Venipak (collection points throughout Lithuania).
- In accordance with the legislation and regulatory documents of the Republic of Lithuania, Electrical and Electronic Goods of satisfactory quality are not returnable or exchangeable, nor are goods that have lost their merchantable appearance or have been used.
- The return of goods purchased by consumers is carried out in accordance with Order No 258 of the Minister of Economy of the Republic of Lithuania of 17 August 2001 of the Civil Code of the Republic of Lithuania. "On the sale of goods and the provision of services when contracts are concluded by means of communication", 29 June 2001. Order No 217 of the Minister of Economy of the Republic of Lithuania. "On the approval of the rules for the return and exchange of items".
6.1 In the event that the Buyer (consumer) withdraws from the contract of sale and purchase of the goods as provided for in Section 2.2 of these Terms and Conditions, the goods shall be returned at the Buyer's expense. The money paid by the Buyer for the delivery of the goods (excluding any additional costs incurred if you have chosen a delivery method other than the cheapest standard delivery method offered by us) shall be refunded within 14 calendar days of the Buyer's written notification of withdrawal from the contract of purchase and sale, provided that the goods are returned to the Seller.
6.2.Goods shall be returned in the original packaging of the consignment together with the product documents (including the warranty card, if it was provided with the product). The VAT invoice and/or cashier's check and the completed return request must be enclosed with the return.
6.3 The Buyer is responsible for the proper assembly and packaging of the returned goods. If the Goods are not complete and/or properly packed, the Seller shall not accept the returned Goods. This also applies to goods that are returned as a "deposit", i.e. brake calipers, starters, etc. (when ordering goods, an additional item "Deposit" appears in the order and is only refunded if the returned goods comply with all the manufacturer's requirements. 6.4 Goods shall not be accepted for return if they have been used, damaged and/or have lost their merchantable appearance (alterations to the appearance of the goods or their packaging which were necessary for the inspection of the goods shall not be deemed to be a material alteration to the appearance of the goods).
6.6 If the delivered goods do not meet the quality requirements, the Buyer shall contact the general contacts at www.gautora.lt.
6.7 Quality goods ordered by special order will not be returned or exchanged. If the Customer refuses to purchase the goods ordered and delivered under a special order, the money paid shall not be refunded.
Processing of personal data
7.1 The Buyer agrees that by clicking on the "Confirm Order" button, the Buyer shall provide his/her personal data in order to allow the Seller to process said data for the purposes of identification of the Buyer, the conclusion of contracts, the execution (online sales) and direct marketing. The Seller confirms that the Seller will not use the Buyer's (natural person's) personal data for direct marketing purposes.
7.2.The Buyer confirms that by clicking on the "Confirm order" button, he/she is informed of his/her right to access the personal data processed by the Seller, to request correction, destruction of his/her personal data or to suspend the processing of his/her personal data when the data are processed in violation of the requirements of the legislation, and may also object to the processing of personal data.
7.3 The Buyer confirms that by clicking on the button "Confirm order", the Buyer is aware that he/she has the right to refuse to provide his/her personal data, but he/she understands that the personal data are necessary and indispensable for the purpose of identifying the Buyer for the purpose of concluding and performing the contract of sale (intemetary trade) and that if the Buyer does not provide the personal data and (or) if he/she does not consent to the processing of the personal data for the purposes set out above, he/she will be prevented from concluding and (or) executing a contract of sale.
7.4 The full rules are set out in the document "Rules on the processing of personal data".
Sending information
8.1 The Seller shall send all notifications to the email address provided by the Buyer in the registration form.
8.2 The Buyer shall send all notifications and questions to the address specified in the "Contact" section of the Seller's e-shop.
Responsibility
9.1 The Buyer shall be responsible for the accuracy of the data provided in the registration form and shall be liable for the consequences and consequences of any incorrect/false data provided in the registration form.
9.2 In accordance with Article 8(2) and (3) of the Law on Electronic Signature of the Republic of Lithuania. The Buyer agrees with the Seller that the confirmation of the Buyer's actions in the e-shop by the log-in data to the e-shop shall have the legal effect of an electronic signature as set out in Article 8(1) of the Law on Electronic Signature of the Republic of Lithuania (i.e. the same legal effect as a signature in written documents). The Buyer is obliged and undertakes to protect his/her login data and not to disclose them to third parties. All actions performed by the Buyer using the Buyer's data shall be deemed to have been performed by the Buyer and the Buyer assumes full responsibility for the nature of the actions performed and the data used.
9.3 The parties shall be liable for the breach of the contract of sale and purchase concluded in the e-shop in accordance with the procedure established by the legislation of the Republic of Lithuania.
Ordering a product by sample
10.1 If the goods presented in the www.gautora.lt catalogue are not available in the warehouses of GAUTORA UAB or the offer of the goods has been made upon a separate request and the buyer wishes to purchase the goods, the contract shall be concluded in accordance with CC 6.356.
10.1.1 A Consumer Sales Contract may be concluded on the basis of samples of items offered to the Buyer by the Seller (description of goods, catalogues, models, etc.).
10.1 2 Unless otherwise provided by law or contract, a contract for sample items shall be deemed to have been concluded when the Seller delivers the items to the place specified in the contract or, if no place of delivery is specified in the contract, to the consumer's place of residence.
10.1.3 The Buyer shall have the right to withdraw from the Contract in accordance with the Samples prior to the delivery of the Goods. However, in this case, the Buyer must reimburse the Seller for the necessary costs incurred by the Seller in connection with the performance of the contract prior to the cancellation, unless the contract provides otherwise.
10.2 When ordering the goods, the seller may request GAUTORA UAB to pay for the goods by prepayment.
Final provisions
12.1 These Rules shall be governed by the laws of the Republic of Lithuania.
12.2 All disagreements arising out of and/or in connection with the Purchase and Sale Agreement between the Buyer and the Seller shall be settled by negotiation. In the event of failure to reach an agreement, disagreements shall be settled in accordance with the procedure established by the legislation of the Republic of Lithuania.
